    17 Nov 2009 | 12:39 am
Levinson Axelrod, a New Jersey law firm, is trying to shut down an ex-employee’s gripe site, alleging cybersquatting and trademark infringement. Edward Heyburn, who worked for Levinson Axelrod from 1998 to 2004, started a “Levinson Axelrod Sucks” website in late September, using the domain name LevinsonAxelrod.net to post personal opinions and complaints about the firm and it’s partners. “I thought this was a very nice way to pull them out of the clouds,” Heyburn said. And out of the clouds they came. Levinson Axelrod has taken the case to court alleging…

Here are a few items that came up recently that reminded me of other things that happened, only less recently: * Social Media Vulnerabilities: From the New York Times Sunday edition came a report of a Hollywood burglary ring whose members not only targeted celebrities, but used celebrity gossip web sites to figure out when those celebrities would be out partying, so they could break in knowing no one would be at home. Granted, celebrities aren’t normal people — their movements are tracked and broadcast with unhealthy intensity. And the burglary ring (alleged, that is)…

When it comes to online marketing, whether you’re going the organic route with SEO and link building or targeting paid search through PPC or both (which you should, if you can, hint-hint), there are few, if any, aspects more important than choosing the right keywords. So how do you choose the right keywords for your enterprise’s website? Depending on whom you ask, there are many ways to go about it, many online tools—Wordtracker, Keyword Discovery—that you can use, and a number of places to get started. But the important thing to remember is that no online tool or SEO expert knows…

This is a flat URL – www.biggestloser.com – www.turbosnake.com - www.magiccrumbs.com These URLs use initial capitals – www.BiggestLoser.com – www.TurboSnake.com – www.MagicCrumbs.com Which of these is easier to read?  Which do you think is more memorable/brandable? Clearly the domain names/URLs using initial capital letters are MUCH easier to read and studies have actually shown that they are easier to remember as our…

  • Common WordPress SEO Mistakes and How To Fix Them

    Mark Fulton
    17 Nov 2009 | 3:05 am
WordPress is an excellent tool for publishing websites and blogs. This widely used CMS software does alot of great things like creating posts, pages and tags with clean URLs, linking everything internally and generating valid code. Oddly enough though, the majority of SEO responsibility is placed within the hands of third-party WordPress theme developers as well as yourself, the site owner. Some theme designers may not be familiar with SEO best practices, so you should take some time to examine your site for any ways to improve it’s effectiveness on search ranking performance.

A quick look at domain name news. Next Thursday is Thanksgiving, which means some interesting things for web traffic. Shopping sites will see high traffic, news sites will see less as people stay home from work. Domain Name Wire will continue publishing next week, but I wanted to get a few thoughts and news items out there before my turkey-induced slumber. Joe Biden did it again. by Karen Bernstein Have UDRP panels gone too far by setting a new standard for determining the identical or confusingly similar element in domain disputes? In his November 13 article, Andrew Allemann reported a WIPO decision denying transfer of Project.Me (project.me GmbH v. Lin, Case No. DME2009-0008 (WIPO Nov. 11, 2009)). Three hackers indicted for hijacking domain name. An indictment against three hackers involved in hijacking the Comcast.net domain name last year shows how easy it is to pull it off: just get access to the administrative contact’s email address. The U.S. government has charged three hackers with doing just that, and using the email address to change the nameservers on Comcast.net at domain name registrar Network Solutions. Blame the hackers, but also Comcast for not having security measures in place with their registrar. Moniker, Fabulous, and GoDaddy each have optional security tools…

    25 Oct 2009 | 7:00 am
Last Sunday I commented on DENIC releasing one- and two-letter domains as well as pure number domains, which were previously impossible to register. This Sunday I will have to comment on the actual results of the allocation process. As it stands now, 28% of all one- or two-letter domains that were claimed and registered during the initial registration phase were acquired by one company only, Tec-Media-Service. The company successfully registered 193 of the short domain names. Realtime.at came in second with 48 domains and Key-Systems secured 19 domains at least. Most other DENIC members,…
  • DENIC to make million-dollar domains available for the first time

    Dominik Mueller

DENIC, the registry of Germany’s .DE top-level domain, has announced that it is going to make one- and two-letter .DE domains available for registration in a few days for the first time. In addition to these, it will then also be possible to register pure number domains such as 123.de, which, unlike under .com, could not have been registered so far. As per DENIC’s rules, it was not allowed to register domains without any letters or domains shorter than three letters under the .DE TLD. Those rules are now about to be changed after a 2008 Frankfurt court ruling involving Volkswagen…

I am a person who is interested in many things. Although this blog is clearly about domain names, I actually enjoy studying other subjects too, such as finance and economics, but do I write about them? Rarely. That is so because whenever I have written a post on something other than domain names, interest in that blog post was low. Too low, I should say. My stats also indicate that the number of readers who unsubscribed was significantly higher on days when I published a finance-related article, for example. I have only written a handful of those so far, but I’m afraid I won’t be…

Search engines have access to tons of valuable information, treasure troves full of clues to human behavior and what their millions of search engine users are up to. That is why the big search engines have great power even beyond their new role as brokers of advertising spaces on the Internet. Every day search engines analyze our behavior and collect data we generate, and which they then store in databases. I have often wondered what data they have exactly and what they’re using them for. I’ve also known that professionals from dozens of industries are working at Google, for…

I feel like I’ve probably told the story a bunch of times (which I am sure I have), but since a number of people have asked me recently, I want to share the story of how I became a domain investor. When I was a NYU in 2002-03, I went to help a family friend clean the movie ride curtains at the Empire State Building since I lived less than a block away. There has been a lot of talk about IDNs here and elsewhere but what does the reality look like for a plain user? As a test, I randomly choose 28 domains from Alexa's top 100 Sites and tried to create a user account with the email address user@宫殿.com. The bleak result: only wikipedia.org accepted the IDN - and later on failed to send a verification ping - all other rejected the email address. IDN domains have standardized since March 2003 (RFC 3490) but as far as I know only one major email provider actually supports IDNs flawlessly… The tested domains in alphabetic order were:…

  • What's Driving Spam and Domain Fraud? Illicit Drug Traffic

    19 Nov 2009 | 11:08 am
Spam is not about who sent it, it's about who benefits from it. For a moment forget everything you know about filters, zombie PCs, firewalls, spoofing, viruses, beisyan algorithms, header forgery, botnets, or blacklists. These are all methods for sending spam or preventing spam delivery. None of these explain why spam is sent and for far too long all the attention has been paid to the effects and not the driving force. Under the endless onslaught of junk mail it is easy to feel that the goal of the game is send spam and annoy us all. But this isn't the goal. The goal of spam is a transaction.
  • A Thought About Not-Quite-ASCII Top Level Domains

    19 Nov 2009 | 9:29 am
ICANN has opened their new fast track process for "countries and territories that use languages based on scripts other than Latin" to get domain names that identify the country or territory in its own language. It's not clear to me what the policy is supposed to be for countries whose languages use extended Latin with accents and other marks that aren't in the ASCII set. Any country that uses an extended Latin character set can use extended characters in 2LDs right now, and I can't offhand think of any whose current unaccented two-letter ccTLD isn't an adequate mnemonic for their name. But…

As I explained my opinion on yesterday’s post, we are either witnessing an investigation or a cover up.  I am not sure which one but since not a single word has been spoken, I have to assume cover up but I am PRAYING that it is an investigation by the FBI.  Short of that, imo, we are getting hosed and lied to and bullshitted by this wall of silence. Maybe MOST domainers are okay with that….I AM NOT! People are moving traffic away. People are moving domains away. People are just moving their business away. People are just moving on. If we don’t start to get…

    Rick Schwartz
    16 Nov 2009 | 2:18 am
Morning Folks!!There is a smaller and smaller group questioning the motives of my posts. I admit I may not be the best person to be so outspoken because of the way it might look, but sitting on the sidelines while the biggest scandal ever is rocking the industry just ain’t my style and this is way too important to worry who will say what and all the other BS. Even those that disagree, do you really question the sincerity of my anger and outrage and love of the industry and what we all do? My anger has subsided a bit because I have been able to express myself over the last few days with…

This is going to be another BARN BURNER! Howard is going to give you a lawyers view of the Oversee contract, LINE BY LINE! Yesterday I touched on the Oversee/Snapnames agreement. Later I posted the following on TheDomains.com where Mike Berkens disects the 12,000 auctions he was involved in with "Halvarez". Thanks Mike for taking the time and expense to do this for all to see and stepping up to cover this story. "Their release could have been one sentence: “I hear-by release Oversee and…

    Rick Schwartz
    12 Nov 2009 | 8:17 am
Morning Folks!! One thing I have always learned in life is the cover up is worse than the crime. We have all learned that. At least we were supposed to learn that the first time you told your parents a lie. You lied about something stupid. I can guarantee it. We barely got punished for the bad thing we did because the lie trumped the bad thing 1000 times over. We have seen it in politics countless times, the coverup is almost always worse than the initial crime. What can I tell you other than my personal opinion and views and what folks out there are wondering right now? I hear domainers…

After much discussion and criticism last week Oversee/SnapNames.com announced today that it has revised and restated the release they are requiring those wanting to accept the settlement for the bidding activities of the bidder Halvarez to sign. As we have discussed here we thought the release was overly broad and the literally reading would release Oversee and Snapnames from all and any liability for any activity on SnapNames related or not related to the bidder Halvarez which was the bidder ID of Nelson Brady, a former employee and officer of the SnapNames. 19 Nov 2009 | 4:37 pm
The whole domain industry has been reeling under the Snap Names revelations over the last few weeks. Is this really such a bad thing? The life-cycle of almost every industry has resulted in the ejection of undesirables and bad practices as the industry begins to clean itself up. From my perspective the Snap Names saga is really where men of conscious have discovered a wrong an decided to make it right. In this case it was a tough call. Just think about it. At some stage there was a board meeting where the CEO of Snap Names reported to the board of Oversee that he’s just discovered a Mount…

It's also worth mentioning the Expiry Domains program we also launched earlier this year. • Saturday Musings – Oversee.Net and Snap Names Fiasco

    14 Nov 2009 | 1:28 pm
For the past couple of weeks I’ve been reading about all of the incredible things happening at Oversee.Net and the Snap Names employee that bid up the auctions. When you think about it, the domain industry is less than transparent so this sort of event should have been expected by everyone. There is just too much money at stake. Employing people is always fraught with potentially dangerous outcomes especially when an employee in a trusted position fails to live up to their CV encrusted character references. When you purchase a business, as is the case with Oversee’s fairly recent purchase…

  • First Class Action Againt SnapNames Filed

    9 Nov 2009 | 2:08 am
We didn’t have to wait long for a class action to be filed. I (http://www.domainnamenews.com/miscellaneous/snapnames-daily-update-sharks-circle/6518)t was just a matter of time before the sharks bit. The weekend gave Cueto Law Group and their lead plaintiff Carlos A. Cueto enough time to put together a filing against SnapNames (https://www.snapnames.com). Andrew at DNW and I were having a call when he ran across the press release marking this as the first class action against SnapNames. It didn’t take long for the sharks to begin circling. It’s come to our attention that class action attorneys already smelling blood in the water have begun investigating the possibility of a class-action case against SnapNames (https://www.snapnames.com). Blim Edelson, Chicago based class-action attorneys, have put up a website (http://www.classactionconnect.com/?q=node/819) to gather up possible plaintiff names and investigate the case. To be clear the site states : The listing of a company is not meant to state or imply that it committed any illegal or improper act; rather only…

    4 Nov 2009 | 3:51 am
According to a statement from Oversee.net’s SnapNames (https://www.snapnames.com), an employee was found to have bid in 5% of their auctions since 2005 and in some cases arranged for a partial refund of the sales price after winning an auction. DNN was able to identify the bidder as Nelson Brady, the VP of Engineering. He was bidding under the username “halvarez”. In a statement issued today, the company offers compensation to any potentially affected customer. For years, the domain community has questioned specific bidding practices by at least one frequent bidder with the…

I have way too many bookmarks so my way to find the Google Adwords tool is archaic (type it in the tool bar over and over every day) but today was worth the humor. # 2 sponsored link was … I will not even link to this site since it does not deserve a link and will never understand how anyone would drop even a $1 for SEO services from someone that has (a) Google in their domain name and (b) a website that many 10 year olds could design better before they brush their teeth in the morning. Granted – they may be SEO wizards but highly, highly doubtful in my book so be careful, if…

If you’re like I am and just have way too much to do then its easy to never follow up on good domains which were recently purchased and developed. Of course, a lot of sales are parked, more will never be developed and some will just sit with empty DNS for years to come but there has to be quite a few examples of great sites around that are new buys (not necessarily new reg – just new change of ownership). Unfortunately, I don’t have time at the moment to do a list of my favs but would love to read about your finds – whether its traffic, creative use of a brandable name…

Halverez has finally been outed – Oversee has stepped up to the plate and not only publicly acknowledged the fraud but taken steps to compensate auction participants and implement policies to prevent this in the future. First, let me say this breach was a breach at the highest level – both personally and professionally for many. However it happens – in domains, real estate auctions, online auctions and more. Remember, the heated argument about Adam Dicker from GoDaddy bidding on names or the questions behind NameJet’s continual stream on non-paying bidders. We do not live in a…

First let me say this is not a post about either Rick personally but it’s about the way of thought many domainers exercise in the current industry. The economic variables of today we are forced to work in will certainly bring opportunity to many domainers but this opportunity must be considered more than just buying a worthy asset at cheaper prices than a year ago. Joel Ohman referenced a quote I made with a great follow article up about his life cycle in the world of business online (note I did not say domain business) and it would be relevant to your future success to read this article to…

  • Interesting Idea By Stephen Douglas At SuccessClick.com

Stephen Douglas over at SuccessClick.com has written a post asking for readers to comment or email him with their thoughts on what the biggest domain scandals have. Knowing Stephen I really think what he puts together around this could be very interesting. We have had our fair share of scandal lately with the Snapnames/Halvarez/Nelson Brady fiasco but, as one commenter brought up, RegisterFly would be considered another pretty big scandal and some would even consider insider bidding on Tdnam auctions at Godaddy.com a bit of a scandal (although taken care of rather rapidly). Today while in our sales meeting I heard on of the frequent comments I hear from people that have spoke to small businesses about online marketing, websites, etc. That comment is "I do not get any business from my website" or  "I do not remember ever getting a call from my website" or something similar. To me this basically means I am walking out with an order or going to be getting one sometime soon. If you are someone that focuses on online advertising or web development or anything related to that field those words should be music to your ears. If you get worried when you hear that…
